Effective Date: 01/01/2026 Last Updated: 01/01/2026

These Terms and Conditions (“Terms”) govern your access to and use of famosatile.com (the “Site”) and the related services, communications, consultations and showroom visits offered by Famosa Inc. , doing business as Famosa – The Surface Studio (“Famosa,” “we,” “us,” or “our”). By accessing or using the Site, submitting a form, or scheduling a visit, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Please read Section 15 carefully. It contains a binding arbitration agreement and class action waiver that affect how disputes are resolved.

1. Eligibility

The Site and our showroom serve homeowners as well as design and building professionals. You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a business or client, you confirm you are authorized to act for them.

Design and building professionals may apply for a trade account. We may ask for proof of professional status, such as a business license, contractor’s license, seller’s permit or resale certificate, and may approve, decline, suspend or end any trade account at our discretion.

2. Use of the Site

You agree to use the Site only for lawful purposes and in line with these Terms. You agree not to:

3. Tile and Natural Stone Disclaimer

Natural stone is a product of nature, and many of our tiles are handmade, hand-finished or reclaimed. Color, shade, veining, pattern, texture, size, thickness and finish can vary from piece to piece and from lot to lot. Natural characteristics, such as fissures, pits, inclusions, crazing, chips on handmade edges and color variation, are part of these materials and are not defects.

Photographs, videos, samples, displays and descriptions are for general reference only and may differ from the material you receive. Colors may appear differently depending on lighting and screen settings. We recommend viewing current stock in person, confirming lot or production numbers, and ordering enough material, including an overage for cuts and breakage, from a single lot to complete your project.

Health and safety notice. Cutting, grinding, drilling or polishing natural stone, porcelain, ceramic and engineered surface products can release respirable crystalline silica dust. Inhaling this dust can cause serious lung disease, including silicosis. Anyone fabricating or installing these products must follow applicable Cal/OSHA and OSHA silica standards, use wet-cutting methods and dust controls, and wear appropriate respiratory protection.

California Proposition 65 WARNING: Tile and stone products can expose you to chemicals including crystalline silica (airborne particles of respirable size), which is known to the State of California to cause cancer. For more information, go to www.P65Warnings.ca.gov.

4. Product Information, Availability and Pricing

We work to keep Site content accurate, but we do not warrant that product descriptions, dimensions, finishes, images, availability or other content are complete, current or error-free. Inventory and manufacturer offerings change frequently, and items featured on the Site may be sold out, discontinued or subject to long lead times.

Prices and promotions are subject to change and are not offers to sell. A sale is binding only when confirmed in a written quote, invoice or order acknowledgment issued by Famosa. We reserve the right to correct errors and to limit or refuse any order.

5. Quotes, Orders, Delivery and Returns

Quotes are valid for the period stated on the quote, or 30 days if no period is stated. Orders, deposits, payment terms, lead times, delivery, pickup, storage, title, risk of loss and returns are governed by the terms on our quotes, invoices and any trade account agreement. If those documents conflict with these Terms, those documents control for that transaction.

Unless otherwise stated in writing, special-order, custom, cut, handmade and natural stone materials are non-returnable, and returns of eligible stock items may be subject to a restocking fee. You are responsible for inspecting materials on delivery or pickup and reporting shortages or visible damage before installation begins. Installation of material is considered acceptance of that material.

Nothing in these Terms limits any rights you have as a consumer that cannot be waived under California law.

6. Design Consultation and Installation

Our team offers material selection guidance and design consultation as a courtesy to help you choose products. That guidance is not architectural, engineering or construction advice. You and your design and building professionals are responsible for confirming that selected materials are suitable for the intended use, including wet areas, exteriors, pools, high-traffic floors, slip resistance and heat exposure, and that layouts and quantities are correct.

Famosa supplies materials and does not install them unless expressly agreed in writing. Installers, contractors and fabricators are independent third parties, and we are not responsible for their workmanship, measurements, substrate preparation, setting materials, sealing or installation methods. Follow the manufacturer’s installation and care instructions and applicable industry standards.

7. Showroom Visits

Showroom visits and consultations are by appointment, Monday through Friday. For your safety, follow staff instructions, do not lift or move heavy materials or displays, keep children under close supervision, and stay in designated areas. You are responsible for any damage you or your guests cause, and you visit at your own risk to the fullest extent permitted by law.

When you submit a form on the Site or through an advertising platform (such as a Facebook or Instagram lead form), you agree that we may contact you by email, phone or text message about your inquiry, appointment or project. If you separately opt in to marketing messages, we may send you news, offers and updates. You may opt out of marketing emails using the unsubscribe link and out of text messages by replying STOP. Consent to marketing messages is not a condition of purchase. Message and data rates may apply. See our Privacy Policy for details.

9. Submissions, Project Photos and Spotlights

If you send us photos, plans, drawings, project details, reviews, suggestions or other materials (“Submissions”), you confirm you have the right to share them. You grant us a non-exclusive, royalty-free, worldwide license to use Submissions to respond to you and provide the Services.

If you submit or approve photos of completed projects featuring our materials for use by Famosa, or agree to be featured in a designer or project spotlight, you grant us a license to use, reproduce and display that content, your name and your business name in our marketing, with credit where practical. We will not publish the address or other identifying details of a private residence without permission.

10. Intellectual Property

The Site and its content, including text, product and project photography, videos, graphics, logos, the names “Famosa” and “The Surface Studio,” and the design and arrangement of the Site, are owned by or licensed to Famosa and protected by copyright, trademark and other laws. Content featuring third-party designers, manufacturers or artisans remains the property of its owners. You may view and print Site content for your personal use or internal business use in evaluating our products. Design professionals may share our product images with their clients solely to present products purchased or being considered for purchase from Famosa. All other use requires our prior written permission.

The Site may contain links to or content from third parties, including social media platforms, manufacturers, the design professionals we spotlight, and affiliated brands. We do not control and are not responsible for third-party sites, content, products, services or practices. Your use of them is at your own risk and subject to their terms. Any agreement you make with a designer, contractor or installer is solely between you and them.

12. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ITS CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. PRODUCT WARRANTIES, IF ANY, ARE THOSE PROVIDED BY THE MANUFACTURER OR STATED IN WRITING ON OUR SALES DOCUMENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAMOSA AND ITS AFFILIATES, OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING INSTALLATION, REMOVAL OR REINSTALLATION COSTS, OR LOST PROFITS, REVENUE OR DATA, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). LIABILITY FOR PRODUCTS PURCHASED IS LIMITED AS STATED IN THE APPLICABLE SALES DOCUMENTS AND WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to defend, indemnify and hold harmless Famosa and its affiliates, owners, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your Submissions, your violation of these Terms or any law, or your infringement of any third party’s rights.

15. Dispute Resolution, Arbitration and Class Action Waiver

Informal resolution. Before filing any claim, you agree to contact us at info@famosatile.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. Any dispute arising from or relating to the Site or these Terms that is not resolved informally will be resolved by binding individual arbitration administered by JAMS under its applicable rules, in Orange County, California, unless the parties agree otherwise. For disputes with consumers, the JAMS Consumer Arbitration Minimum Standards apply. The arbitrator may award the same individual relief a court could. Judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

Class action waiver. You and Famosa agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing info@famosatile.com within 30 days of first accepting these Terms, stating your name and that you opt out.

Sales documents. Disputes regarding a specific purchase are governed by the dispute terms, if any, in the applicable quote, invoice or trade account agreement.

16. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Orange County, California.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last Updated” date. Your continued use of the Site after changes are posted means you accept the updated Terms.

18. Termination

We may suspend or end your access to the Site or any account at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive, including Sections 9 through 16.

19. General

These Terms, together with our Privacy Policy and any applicable quotes, invoices or trade account agreements, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them without restriction. Section headings are for convenience only.
